1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the Kaur’s Farm mobile web experience, customer portal, ordering flows, and related services (collectively, the “Services”) offered by Kaur’s Farm (“we”, “us”, “our”). By creating or using an account, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Eligibility

You represent that you are at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872. If you use the Services on behalf of another person or entity, you confirm that you are authorised to do so.

3. Account & communications

Access may require a valid Indian mobile number and OTP or password-based authentication. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account except where caused by our gross negligence or wilful misconduct. We may send you transactional messages (order status, delivery, payments) and, where permitted, service-related notices by SMS, WhatsApp, email, or in-app prompts.

4. Nature of products

We offer fresh produce, grocery-style items, subscription vegetable baskets, and related farm products. Agricultural items are natural and may vary by season, size, weight, appearance, and availability. Images are illustrative. Minor substitutions consistent with industry practice may apply where an item is unavailable—we will endeavour to provide comparable quality and value.

5. Orders, pricing & taxes

All orders are offers that we may accept or decline (for example, due to stock, service area, or suspected fraud). Prices, basket compositions, delivery fees, and promotions are as displayed at checkout unless clearly stated otherwise. Applicable taxes (such as GST, where chargeable) will be shown or invoiced as required under Indian law.

6. Delivery

Delivery is available only in areas we currently serve. Slots and timelines are estimates and may be affected by weather, traffic, force majeure events, or operational constraints. Risk of loss for perishable goods generally passes on delivery to the address you provide. If you are unavailable, our delivery policy (including redelivery or cancellation charges) as communicated at the time of order or on our channels will apply.

7. Payments

Payments are processed through secure third-party payment gateways and methods made available in the app (including UPI, cards, net banking, and wallets as applicable). You authorise us and our payment partners to charge the total amount for accepted orders. You agree to comply with the payment provider’s terms. We do not store complete card numbers on our servers where tokenisation or gateway-hosted fields are used.

8. Wallet, credits & promotional balance

If we offer a wallet, store credit, coins, or similar balances, they are redeemable only within the Services under the rules we publish. Unless stated otherwise, such balances may not be transferable, may expire, and are not legal tender. Misuse, chargebacks without valid basis, or breach of these Terms may lead to suspension, forfeiture, or adjustment of balances as permitted by law.

9. Subscriptions & recurring plans

Subscription or recurring basket plans renew and bill as described at signup or in your account settings. You may pause, modify, or cancel where the product flow allows, subject to cut-off times already communicated for upcoming deliveries. No guarantee is made of uninterrupted service if supply, logistics, or safety considerations require temporary changes.

10. Cancellations & refunds

Cancellation and refund eligibility depends on product type (especially perishables), preparation status, and time of request. Where the Consumer Protection Act, 2019 and applicable rules grant you rights, those rights are preserved. For other cases, our reasonable commercial policy—shown before payment or in order communications—will apply. Refunds, if approved, are typically credited to the original payment method or wallet within timelines dependent on banks and partners.

11. Acceptable use

You will not misuse the Services, interfere with security, scrape data without consent, harass staff or riders, submit false information, or attempt to circumvent payment or delivery verification. We may suspend or terminate access for violations.

12. Intellectual property

Branding, logos, content, software, and materials in the Services are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable licence to use the Services for personal, non-commercial ordering. No reverse engineering or unauthorised copying.

13. Third-party services

Maps, analytics, messaging, and payment providers may process data under their policies. Your use of those features may be subject to additional third-party terms.

14. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Services and products are provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation. Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded under Indian law, including consumer statutory rights where applicable.

15. Limitation of liability

Subject to applicable law, our aggregate liability arising out of or relating to the Services or these Terms is limited to the amount you paid us for the specific order giving rise to the claim in the three (3) months preceding the event, or ₹2,000, whichever is higher—except where such limitation is prohibited (for example, death, personal injury due to negligence, fraud, or other non-excludable claims). We are not liable for indirect, consequential, or punitive damages except where such exclusion is unlawful.

16. Indemnity

You agree to indemnify and hold harmless Kaur’s Farm and its team against claims, losses, and reasonable expenses arising from your breach of these Terms, misuse of the Services, or violation of law—except to the extent finally judicially determined to result primarily from our own wrongdoing.

17. Force majeure

We are not liable for delay or failure caused by events beyond reasonable control, including natural disasters, epidemics, government actions, strikes, utility failures, or supply chain disruptions.

18. Governing law & disputes

These Terms are governed by the laws of India. Subject to your rights under the Consumer Protection Act, 2019 (including access to consumer commissions where available), courts at Chandigarh, India shall have exclusive jurisdiction over disputes, unless another forum is mandated by law.

19. Changes

We may update these Terms by posting a revised version in the Services. Material changes may be highlighted or require renewed acknowledgement where required. Continued use after the effective date constitutes acceptance unless applicable law requires otherwise.

1. Who we are

This Privacy Policy describes how Kaur’s Farm (“we”, “us”, “our”) collects, uses, stores, and shares personal data when you use our customer website/app experience, place orders, pay, or interact with support. We operate primarily in India and process personal data in line with applicable Indian laws, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Information Technology Act, 2000 and rules issued thereunder, as applicable.

2. Scope

This Policy applies to customers and prospective customers who use our digital Services. Staff, vendors, and other categories may receive separate notices where relevant.

3. Personal data we collect

Depending on how you use the Services, we may process:

  • Identity & contact: name, mobile number, email (if provided), delivery addresses, landmark notes.
  • Account & transaction: order history, basket preferences, subscription selections, wallet or credit balances, invoices, refunds, support tickets.
  • Payment information: payment method type, transaction references, and status as returned by our payment partners. Card or UPI credentials are handled by certified payment gateways; we do not receive full card numbers where tokenised flows are used.
  • Device & technical: IP address, browser or device type, approximate location derived from IP or address, cookies or similar identifiers, crash or performance diagnostics where enabled.
  • Communications: messages you send us (including WhatsApp or SMS threads where you opt in), and recordings or logs needed for quality and dispute resolution.

4. How we use personal data

We use data to:

  • create and secure your account (including OTP verification);
  • process, fulfil, and deliver orders and subscriptions;
  • collect payments, prevent fraud, and reconcile transactions;
  • provide customer support and respond to requests;
  • send transactional notifications and, where you consent, marketing or promotional messages;
  • improve products, routing, and user experience through analytics in aggregated or de-identified form where possible;
